Terms of Service

These Terms of Service ("Terms") govern your access to and use of Tipply, available at tipply.app (the "Service"). By creating an account or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

Eligibility and accounts

You must be of legal drinking age in your jurisdiction to use the Service. You are responsible for the activity that occurs under your account and for keeping your account credentials secure. You agree to provide accurate information and to keep it up to date.

Acceptable use

When using the Service, you agree not to:

  • Use the Service for any unlawful purpose or in violation of these Terms;
  • Attempt to access, tamper with, or disrupt the Service, its infrastructure, or other users’ accounts;
  • Upload content that is illegal, infringing, harmful, or that you do not have the right to share;
  • Scrape, harvest, or bulk-download content except as expressly permitted;
  • Misuse invitations, ratings, comments, or other social features to spam or harass others.

Your content

You retain ownership of the recipes, ratings, comments, menus, and other content you submit ("Your Content"). By submitting Your Content, you grant Tipply a non-exclusive, worldwide, royalty-free license to host, store, display, and use it for the purpose of operating and improving the Service. You are responsible for Your Content and represent that you have the rights necessary to share it.

Alcohol and responsible use

Tipply provides cocktail recipes and related information for personal, informational use. Nothing on the Service is medical, dietary, or professional advice. Please drink responsibly and comply with all applicable laws. You are solely responsible for your own consumption and for anyone you serve.

Intellectual property

The Service, including its design, software, and Tipply branding, is owned by Tipply and protected by intellectual-property laws. Except for Your Content, you may not copy, modify, distribute, or create derivative works from the Service without our prior written permission.

Recipe content and attribution

Recipes and related information on Tipply are compiled from a variety of publicly available and published sources, including cocktail books and other publications. Where a recipe is drawn from a known source, we aim to attribute it to that source.

A recipe — its list of ingredients and basic preparation steps — is functional information and is generally not protected by copyright. Tipply does not claim authorship of, or exclusive rights in, the underlying recipes, and makes no claim to any trademark or other rights belonging to the original creators, authors, or publishers of the sources we reference. Any original creative expression, text, photographs, or branding belonging to a third-party source remains the property of that source.

Tipply’s own contributions — including our compilation and organization of recipes, our database, chemistry and flavor analysis, the descriptions we author, and the design and software of the Service — are owned by Tipply.

If you are a rights holder and believe that content on the Service infringes your rights or is attributed incorrectly, please contact us and we will review the matter and remove or correct the content as appropriate.

Owning a source

Some sources on Tipply are copyrighted books. To unlock a copyrighted source’s recipes, you confirm that you own a copy — an honor-system attestation, the same way you attest to being of legal drinking age. Out of respect for the authors and publishers who created these works, you agree not to mark a copyrighted source as owned unless you genuinely own a copy of it. Falsely claiming to own a copyrighted source you do not possess is a violation of these Terms.

Third-party services and links

The Service may integrate with or link to third-party services (for example, sign-in providers, mapping, and retailer links). We are not responsible for the content, policies, or practices of third parties, and your use of them is governed by their own terms.

Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.

Limitation of liability

To the maximum extent permitted by law, Tipply will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, or goodwill, arising out of or related to your use of the Service.

Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your access if you violate these Terms or if we discontinue the Service. Provisions that by their nature should survive termination will survive.

Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will take reasonable steps to notify you. Your continued use of the Service after the changes take effect constitutes acceptance of the updated Terms.
